Terms and conditions
1.1 All offers, orders and agreements of v.o.f. Chamberline (hereinafter: chamberline.nl) shall be subject to these General Terms and Conditions of Sale (hereinafter: Terms and Conditions) to the exclusion of any other general terms and conditions. These Terms and Conditions have been filed with the Chamber of Commerce in 's-Hertogenbosch under number 17220891 and will be sent free of charge upon request. These Terms and Conditions can also be consulted via the internet at: www.chamberline.nl
1.2 By placing an order with chamberline.nl, you agree to these Terms and Conditions.
1.3 These Terms and Conditions may only be departed from in writing. In that case, all other provisions of these Terms and Conditions shall remain in full force and effect.
1.4 All rights and claims stipulated in these Terms and Conditions and in any further agreements for the benefit of chamberline.nl shall also apply for the benefit of any intermediaries and other third parties engaged by chamberline.nl.
Article 2. Offers/agreements
2.1 All offers from chamberline.nl are without obligation. Chamberline.nl has the right to change prices, in particular when this is necessary on the basis of (legal) regulations.
2.2 An agreement is only concluded once chamberline.nl has accepted your order. Chamberline.nl has the right to refuse orders with reasons or to attach special conditions to the delivery. If your order is not accepted, you will be notified of this within ten (10) working days.
Article 3. Prices and payments
3.1 The prices stated for the offered articles and services are in euros, including VAT and excluding administration and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.
3.2 You can pay by using one of the payment methods offered during the ordering process. Further (payment/order) conditions may apply to your order. In the case of payment by bank or giro, the date of payment is considered to be the date on which the giro or bank account of chamberline.nl is credited.
3.3 If you fail to make full payment on time, chamberline.nl has the right to suspend or terminate the relevant agreement and any related agreements.
Article 4. Delivery
4.1 The delivery times stated on the website are indicative. You will receive your order as soon as possible and within (7) working days at the latest, unless otherwise specified by chamberline.nl. In the latter case, you will be notified in good time. Until the time of delivery, you are entitled to cancel the contract free of charge. If the delivery period is exceeded, this does not entitle you to compensation.
4.2 Delivery takes place at the moment the items are offered at the specified delivery address.
Article 5. Retention of title
5.1 Ownership of the goods supplied will pass to you once you have paid the amount due. The risk in respect of the goods passes to you at the time of delivery.
Article 6. Intellectual and industrial property rights
6.1 You must fully and unconditionally respect all intellectual and industrial property rights vested in the items supplied by chamberline.nl.
6.2 Chamberline.nl does not guarantee that the items supplied to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.
Article 7. Advertising and liability
7.1 Check the delivered items immediately upon receipt. You must report any defects in writing with reasons to Chamberline no later than within two (2) months of discovery.
7.2 If it has been demonstrated that an item does not conform to the agreement, chamberline.nl has the option either to replace the item with a new one upon its return or to refund the invoice price plus any shipping costs paid for it.
7.3 If for any reason you do not want an item after all, you have the right to return the item to chamberline.nl within seven (7) working days of delivery and to cancel the agreement. Return shipments in this case will only be accepted if the packaging of the item is undamaged. If you have already paid for the item in question, the amount will be refunded by chamberline.nl within thirty (30) days at the latest. The direct costs of returning the item shall be borne by you.
